1. ACCEPTANCE OF THESE TERMS
Welcome to Victory Place Coaching. These Terms of Service (“Terms”) govern your access to and use of the Victory Place Coaching website, digital products, online courses, educational materials, coaching programs, individual coaching sessions, group coaching sessions, workshops, resources, and other products or services offered by Carol Wieck, doing business as Victory Place Coaching (“Victory Place Coaching,” “we,” “us,” or “our”).
By accessing our website, purchasing a product or service, enrolling in a course or program, or participating in coaching, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, please do not purchase or use our products or services.
2. OUR SERVICES
Victory Place Coaching provides educational products, personal development resources, wellness education, and coaching designed to help individuals pursue positive changes in their health, habits, mindset, personal growth, and lives.
Our offerings may include:
Digital courses and programs;
Downloadable guides, workbooks, worksheets, videos, audio recordings, and other digital resources;
Individual coaching;
Group coaching;
Workshops, classes, challenges, or educational programs; and
Other related educational or coaching products and services.
Specific features, pricing, duration, access periods, and other terms may vary by product or service and will be described on the applicable sales or checkout page.
3. COACHING IS NOT MEDICAL OR MENTAL HEALTH CARE
Victory Place Coaching provides coaching, education, encouragement, and personal development services. We do not provide medical care or licensed healthcare services.
Carol Wieck and Victory Place Coaching do not, through the services offered under these Terms, diagnose, treat, cure, or prevent any disease, illness, injury, mental health condition, or other medical condition.
Nothing provided through our website, courses, coaching, programs, digital products, communications, or other materials is intended to substitute for advice, diagnosis, or treatment from a physician, psychologist, therapist, registered dietitian, licensed mental health professional, or other qualified healthcare provider.
You should consult an appropriately qualified healthcare professional regarding medical conditions, symptoms, medications, dietary changes, exercise programs, mental health concerns, or other matters requiring professional healthcare advice.
Never disregard professional medical advice or delay seeking medical care because of information received through Victory Place Coaching.
If you believe you are experiencing a medical or mental health emergency, contact appropriate emergency services immediately.
4. PERSONAL RESPONSIBILITY
You understand that coaching and educational programs require your active participation and personal decision-making.
You remain solely responsible for your choices, actions, health decisions, lifestyle decisions, implementation of information, and results.
You agree to use your own judgment and to seek qualified professional advice when appropriate.
You understand that information that may be appropriate for one person may not be appropriate for another person.
5. NO GUARANTEE OF RESULTS
Victory Place Coaching is committed to providing high-quality educational materials and coaching; however, we cannot and do not guarantee any particular result.
Examples, testimonials, success stories, or statements regarding results experienced by Carol Wieck, clients, students, or other individuals are illustrative only and do not constitute promises or guarantees that you will achieve the same or similar results.
Your results may vary depending on many factors, including your individual circumstances, health, effort, consistency, participation, choices, experience, and other factors outside our control.
You acknowledge that purchasing a course, digital product, or coaching service does not guarantee improvements in health, weight, fitness, relationships, finances, career, emotional well-being, lifestyle, or any other particular outcome.
6. ELIGIBILITY
You must be at least 18 years old to purchase our products or services unless we expressly agree otherwise in writing and any legally required parental or guardian consent has been obtained.
By making a purchase, you represent that you have the legal capacity to enter into these Terms.
7. DIGITAL PRODUCTS AND COURSES
When you purchase a digital product or course, you receive a limited, personal, non-exclusive, non-transferable, revocable license to access and use that material for your own personal purposes.
Your purchase does not transfer ownership of the course, program, videos, recordings, worksheets, workbooks, written materials, methods, frameworks, designs, or other intellectual property to you.
Unless we expressly state otherwise, you may not:
Share your login credentials or course access with another person;
Copy or distribute our materials;
Upload our materials to another website, platform, file-sharing service, or artificial intelligence system for redistribution;
Sell, sublicense, rent, or give our materials to another person;
Record, reproduce, or distribute course or coaching content;
Modify our materials and represent them as your own;
Use our materials to create a competing course, coaching program, product, or service; or
Use our intellectual property for commercial purposes without prior written permission.
Each purchase is intended for one individual unless the applicable offer expressly states otherwise.
8. INTELLECTUAL PROPERTY
Unless otherwise stated, the content provided by Victory Place Coaching—including course materials, videos, audio recordings, worksheets, workbooks, graphics, written materials, frameworks, exercises, program names, presentations, website content, and other original materials—is owned by Carol Wieck/Victory Place Coaching or used with permission.
These materials are protected by applicable copyright, trademark, and other intellectual property laws.
You may use purchased materials only as expressly permitted under these Terms.
Nothing in these Terms grants you ownership rights in our intellectual property.
9. PAYMENTS
Prices for products and services are displayed at the time of purchase and are subject to change.
You agree to provide accurate and current billing and payment information and authorize the applicable payment processor to charge the payment method you provide for your purchase.
Digital products and courses are generally paid in full at the time of purchase unless otherwise expressly stated.
Individual or group coaching programs may, now or in the future, be offered with installment or payment-plan options.
If you select a payment plan, you are agreeing to pay the entire purchase price according to the payment schedule presented at checkout. A payment plan is a method of paying the total purchase price and is not a month-to-month subscription unless expressly identified as such.
Failure to participate in coaching, access course materials, attend sessions, or complete a program does not automatically cancel an agreed payment obligation.
We reserve the right to suspend access to products or services if a required payment becomes overdue, subject to applicable law and the terms presented at purchase.
10. SUBSCRIPTIONS AND RECURRING SERVICES
Victory Place Coaching does not currently offer subscription services under these Terms.
If we offer subscriptions, memberships, or other automatically renewing services in the future, the applicable price, billing frequency, renewal terms, cancellation procedures, and other material conditions will be disclosed before purchase.
No customer will be enrolled in an automatically renewing subscription merely because these Terms permit us to offer subscriptions in the future.
11. DIGITAL PRODUCT REFUND POLICY
Because digital products, downloadable materials, and online course content may be delivered or made accessible immediately after purchase, sales of digital products and digital courses are final and non-refundable once access or delivery has been provided, except where otherwise expressly stated at the time of purchase or where a refund is required by applicable law.
Please review product descriptions carefully before purchasing.
If you experience a technical problem that prevents you from accessing a product you purchased, contact us at victoryplacecoaching@gmail.com so we can reasonably attempt to resolve the issue.
12. COACHING CANCELLATIONS, RESCHEDULING, AND REFUNDS
Terms applicable to individual or group coaching—including program length, number of sessions, payment schedule, cancellation requirements, rescheduling rules, missed-session policies, and any applicable refund terms—may be provided on the sales page, checkout page, coaching agreement, or enrollment materials for the particular coaching service.
Those specific terms become part of your agreement with Victory Place Coaching when you purchase or enroll in that service.
Unless otherwise stated in writing for a particular coaching offer, scheduled individual coaching sessions should be canceled or rescheduled at least 48 hours in advance.
Sessions canceled with less than 48 hours' notice, or sessions that a client fails to attend, may be considered used and non-refundable except in circumstances we determine warrant an exception or where otherwise required by law.
Group coaching sessions generally cannot be individually rescheduled because they are held for multiple participants.
If Victory Place Coaching must cancel an individual session, we will make reasonable efforts to reschedule it.
13. GROUP COACHING AND CONFIDENTIALITY
Group coaching involves participation with other individuals. Participants may voluntarily share personal information during group sessions.
We ask all participants to respect the privacy and confidentiality of other participants. You agree not to record, reproduce, distribute, publish, or intentionally disclose another participant's personal statements or identifying information without that person's permission.
However, because group programs involve independent third parties, Victory Place Coaching cannot guarantee that another participant will maintain confidentiality.
You should therefore use appropriate discretion when deciding what personal information to share in a group setting.
14. COACHING RELATIONSHIP AND CLIENT COMMUNICATIONS
Coaching is a collaborative educational and personal-development relationship. It is not a fiduciary, medical, psychotherapeutic, legal, financial, or other licensed professional relationship.
You are responsible for deciding whether and how to implement ideas discussed during coaching.
We may establish reasonable communication boundaries, business hours, session procedures, and methods of communication for particular coaching programs.
Purchasing coaching does not create unlimited access to Carol Wieck outside the communication arrangements included with the particular program.
15. TESTIMONIALS
Our website or promotional materials may include testimonials, reviews, or examples of experiences from clients or customers.
Testimonials reflect the experiences of the individuals providing them. They are not guarantees, promises, or representations that every customer or coaching client will experience the same results.
Individual results vary.
16. WEBSITE INFORMATION
We make reasonable efforts to provide useful and accurate information, but we do not guarantee that every statement on our website or in our materials will always be complete, current, or error-free.
We may update, modify, discontinue, or correct website content, products, programs, pricing, or services at any time, subject to our existing contractual obligations and applicable law.
17. THIRD-PARTY SERVICES AND LINKS
Our website or programs may contain links to third-party websites, software, payment processors, platforms, products, or services.
Victory Place Coaching does not control those third parties and is not responsible for their content, privacy practices, availability, security, products, or services.
Your use of third-party services may be governed by separate terms and privacy policies provided by those third parties.
18. ACCEPTABLE USE
You agree not to use our website, programs, communities, coaching services, or materials to:
Violate applicable law;
Harass, threaten, abuse, or harm another participant or person;
Disrupt a course, group, community, or coaching environment;
Attempt to gain unauthorized access to another person's account;
Distribute malware or harmful code;
Infringe intellectual property or privacy rights;
Scrape, systematically copy, or improperly reproduce our content; or
Use our services for fraudulent or unlawful purposes.
We reserve the right to restrict or terminate access for serious or repeated violations of these requirements.
19. TERMINATION OF PARTICIPATION
Victory Place Coaching may terminate or restrict a person's participation in a coaching program, course, group, or community when reasonably necessary because of harassment, threatening conduct, illegal activity, material violation of these Terms, misuse of intellectual property, persistent disruption, or nonpayment.
Any refund following termination will be determined by the terms applicable to the particular service, the circumstances involved, and applicable law.
20. ASSUMPTION OF RISK
You acknowledge that making changes involving health, exercise, nutrition, habits, relationships, personal development, or lifestyle may involve risks and that individual circumstances vary.
You agree that you are responsible for determining, with appropriate professional assistance when necessary, whether particular activities or changes are suitable for you.
You voluntarily assume the risks associated with your personal decisions and implementation of educational or coaching information, to the fullest extent permitted by law.
21. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, PRODUCTS, PROGRAMS, MATERIALS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
VICTORY PLACE COACHING DISCLAIMS WARRANTIES TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
Nothing in these Terms excludes any warranty, right, or protection that cannot legally be excluded under applicable law.
22. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAROL WIECK AND VICTORY PLACE COACHING WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE, PRODUCTS, PROGRAMS, MATERIALS, OR COACHING SERVICES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PARTICULAR PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO VICTORY PLACE COACHING FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
These limitations do not apply where applicable law prohibits their exclusion or limitation.
23. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Carol Wieck and Victory Place Coaching from third-party claims, liabilities, damages, or reasonable expenses arising from your unlawful use of our services, your infringement of another person's rights, or your material violation of these Terms.
This provision does not require you to indemnify Victory Place Coaching for liability that cannot lawfully be shifted to you.
24. PRIVACY
Your use of our website and services may involve the collection and processing of personal information.
Our practices regarding personal information should also be governed by our separate Privacy Policy, which should be made available on our website.
Please remember that ordinary email and online communications may not always be completely secure. Do not send highly sensitive medical, financial, or other confidential information by ordinary email unless specifically requested through an appropriate secure method.
25. ELECTRONIC COMMUNICATIONS
By purchasing products or services or otherwise communicating with Victory Place Coaching electronically, you consent to receive transactional communications relating to your purchases, account, coaching services, programs, or customer-service requests electronically.
Marketing communications will be handled in accordance with applicable law and any choices provided to you.
26. FORCE MAJEURE
Victory Place Coaching will not be responsible for delays or inability to perform caused by circumstances reasonably outside our control, including severe weather, natural disasters, widespread internet or technology failures, government actions, emergencies, serious illness, or failures of third-party platforms or service providers.
When reasonably possible, we will make appropriate efforts to resume or reschedule affected services.
27. GOVERNING LAW
These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-law principles, except to the extent applicable federal law or other mandatory law provides otherwise.
To the extent legally permitted, disputes arising from these Terms or our services shall be brought in an appropriate court having jurisdiction in or serving Hall County, Nebraska.
Nothing in this section eliminates any consumer right or remedy that cannot lawfully be waived.
28. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
29. NO WAIVER
Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.
30. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements.
When we make changes, we will update the “Last Updated” date at the top of these Terms.
Material changes will apply prospectively as required by applicable law. Terms governing a particular completed purchase will not be retroactively changed where doing so would violate applicable law or an existing contractual obligation.
Your continued use of our website or services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
31. ENTIRE AGREEMENT
These Terms, together with any applicable sales page, checkout terms, coaching agreement, refund policy, Privacy Policy, and other terms expressly incorporated into your purchase, constitute the agreement between you and Victory Place Coaching concerning the applicable products and services.
If specific written terms for a particular coaching program conflict with these general Terms, the specific terms for that program will control with respect to that program.
